Przemys\u0142owa 2, entered in the Business Register of the National Court Register under the number 0000412832 (hereinafter: TRIBAG SA), NIP: 6252318182, REGON: 240448269, share capital of PLN 1,000,000.00, having the status of a Large Enterprise within the meaning of the provisions of the Act on Counteracting Excessive Delays in Commercial Transactions.<\/li>\n\n\n\n<li><strong>Personal Data <\/strong>&#8211; information about an individual identified or identifiable by one or more specific factors determining physical, physiological, genetic, mental, economic, cultural or social identity, including name, contact details, device IP, location data, internet identifier and information collected through cookies and other similar technology.<\/li>\n\n\n\n<li><strong>Policy <\/strong>&#8211; this Privacy Policy.<\/li>\n\n\n\n<li><strong>GDPR <\/strong>&#8211; Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95\/46\/EC.<\/li>\n\n\n\n<li><strong>Website<\/strong> &#8211; the website operated by the Data Controller at https:\/\/tribag.pl\/.<\/li>\n\n\n\n<li><strong>User <\/strong>&#8211; any individual visiting the Website or using one or more of the services or functionalities described in the Policy, or any person contacting the Data Controller through the channels made available by the Data Controller (telephone, email).<\/li>\n<\/ul>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>DATA PROCESSING<\/strong><\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In connection with the User\u2019s use of the Website, the Data Controller collects data to the extent necessary for the provision of individual services offered, as well as information about the User\u2019s activity on the Website.<\/li>\n\n\n\n<li>In connection with the initiation of contact by the User, the Data Controller collects data to the extent necessary to respond and further contact in the matter with which the User addressed the Data Controller. Among other things, the Data Controller processes the following types of personal data: name, surname, telephone number, e-mail address and other data provided by the User to the Data Controller. Personal data is collected directly from the User at the moment an enquiry is submitted to\/contact is initiated with the Data Controller.<\/li>\n<\/ul>\n\n\n\n<p>The detailed rules and purposes of the processing of Personal Data collected during the User\u2019s use of the Website and in connection with initiating contact with the Data Controller are described below.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>PURPOSES AND LEGAL BASIS OF DATA PROCESSING<\/strong><\/li>\n<\/ol>\n\n\n\n<p><strong>USE OF THE WEBSITE<\/strong><\/p>\n\n\n\n<p>Personal data of all persons using the Website (including IP address or other identifiers and information collected through cookies or other similar technologies) are processed by the Data Controller:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>in order to provide services electronically in terms of providing Users with access to the content collected on the Website &#8211; in which case the legal basis for the processing is the necessity of the processing for the performance of the contract (Article 6(1)(b) RODO);<\/li>\n\n\n\n<li>for analytical and statistical purposes \u2013 in which case the legal basis for the processing is the Data Controller\u2019s legitimate interest (Article 6(1)(f) RODO), consisting in conducting analyses of Users\u2019 activities, as well as their preferences in order to improve the functionalities used and services provided;<\/li>\n\n\n\n<li>for the purposes of possible establishment and investigation of claims or defence against claims &#8211; the legal basis for the processing is the Data Controller\u2019s legitimate interest (Article 6(1)(f) RODO), consisting in the protection of its rights.<\/li>\n<\/ul>\n\n\n\n<p>The User\u2019s activity on the Website, including his\/her Personal Data, is recorded in system logs (a special computer program used to store a chronological record containing information about events and activities that concern the IT system used by the Data Controller to provide its services). The information collected in the logs is processed primarily for purposes related to the provision of services. The Data Controller also processes them for technical, administrative purposes, for the purposes of ensuring the security of the IT system and the management of this system, as well as for analytical and statistical purposes &#8211; in this regard, the legal basis for processing is the Data Controller\u2019s legitimate interest (Article 6(1)(f) RODO).<\/p>\n\n\n\n<p><strong>CONTACTING THE DATA CONTROLLER<\/strong><\/p>\n\n\n\n<p>The User\u2019s personal data are processed for the purposes of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>responding to enquiries made to the Data Controller by telephone or sent by email (legal basis Article 6(1)(f) RODO &#8211; i.e. implementation of the Data Controller\u2019s legitimate interest)<\/li>\n\n\n\n<li>resulting from the Data Controller\u2019s legitimate interests, including, but not limited to, the establishment, defence and assertion of claims and the creation of compilations, analyses and statistics for the Data Controller\u2019s internal needs, ensuring the safety of the services, as well as their continuous improvement (legal basis Article 6(1)(f) RODO).<\/li>\n<\/ul>\n\n\n\n<p>Your personal data may also be shared with CRH Group members. The basis for sharing personal data is the Data Controller\u2019s legitimate interest (Article 6(1)(f) RODO), consisting in managing a database of business contacts.<\/p>\n\n\n\n<p>The provision of data is voluntary, but necessary to process the request.<\/p>\n\n\n\n<p><strong>DIRECT MARKETING<\/strong><\/p>\n\n\n\n<p>Personal data are also processed for the purpose of direct marketing carried out in traditional form (e.g. by mail) (basis under Article 6(1)(f) RODO).<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>COOKIES AND SIMILAR TECHNOLOGY<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Cookies are small text files installed on the device of the User browsing the Website. Cookies collect information to facilitate the use of the Website &#8211; e.g. by remembering the User\u2019s visits to the Website and the actions they perform.<\/p>\n\n\n\n<p><strong>\u201cSERVICE\u201d COOKIES<\/strong><\/p>\n\n\n\n<p>The Data Controller uses so-called \u201cservice cookies\u201d primarily in order to provide the User with electronic services and to improve the quality of these services. In this regard, the Data Controller and other entities providing analytical and statistical services to the Data Controller use cookies to store information or access information already stored in the User\u2019s telecommunications terminal equipment (computer, phone, tablet, etc.). Cookies used for this purpose include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>user input cookies(session ID) for the duration of the session;<\/li>\n\n\n\n<li>multimedia player session cookies (e.g. flash player cookies), for the duration of the session;<\/li>\n\n\n\n<li>persistent cookies used to personalise the user interface for the duration of the session or slightly longer (user interface customisation cookies).<\/li>\n<\/ul>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>ANALYTICAL TOOLS USED BY THE DATA CONTROLLER\u2019S PARTNERS<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The Data Controller and its Partners apply various solutions and tools used for analytical and marketing purposes. Below you will find basic information about these tools. For more detailed information, please refer to the privacy policy of the respective partner.<\/p>\n\n\n\n<p><strong>GOOGLE ANALYTICS<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Google Analytics cookies are files used by Google to analyse your use of the Website, to compile statistics and reports on the functioning of the Website. Google does not use the data collected to identify the User, nor does it combine this information to enable identification. Google Tag Manager (GTM) is a tool that allows the Data Controller to add, modify and manage tracking codes and other analytics tools on the Service. YouTube is a service of Google LLC, D\/B\/A YouTube. 901 Cherry Ave., San Bruno, CA 94066, USA. All videos are embedded in a privacy-protected mode, which means that no data about the User is sent to Google until the User plays the video. When the User plays the video, YouTube saves cookies on the User\u2019s device and receives information about the playback of the video from a specific website, even if the User does not have a Google account or is not logged in. Once the recording has been played, the Data Controller has no influence on the data transfer. As a rule, the data are processed for the duration of the service (providing access to the content of the Website), until the consent is withdrawn or until an effective objection is raised against the data processing in cases where the legal basis\u00a0 the data processing is the legitimate interest of the Data Controller.<\/li>\n\n\n\n<li>The data processing period may be extended in cases where the processing is necessary to establish and assert possible claims or to defend against claims, and thereafter only in the case and to the extent required by law. After the expiry of the processing period, the data will be irreversibly deleted or anonymised.<\/li>\n<\/ul>\n\n\n\n<ol start=\"8\" class=\"wp-block-list\">\n<li><strong>USER RIGHTS<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The User is entitled to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>right of access &#8211; The right of access allows the User to obtain information about the personal data processed by the Data Controller and certain other information (such as that contained in the Policy);<\/li>\n\n\n\n<li>Right to rectification &#8211; The User has the right to rectify personal data if it is incorrect or incomplete;<\/li>\n\n\n\n<li>Right to erasure \u2013 The User may request that his\/her personal data be erased unless there is an obligation to retain it. The right to erasure is not a right that applies without exception. The Data Controller has the right to further process the User\u2019s personal data if such processing is necessary for the fulfilment of the Data Controller\u2019s legal obligations or for the investigation, exercise or defence of legal claims;<\/li>\n\n\n\n<li>Right to restrict processing &#8211; This right includes restricting the very use or manner in which the personal data is used. This right is limited to certain cases and in particular applies if: (a) the Personal Data is incorrect; (b) the processing is unlawful and the User refuses to erase it; (c) the data are no longer needed but the User needs them to assert, exercise or defend against legal claims. If processing is restricted, the data may still be stored by the Controller but not used;<\/li>\n\n\n\n<li>Right to data portability &#8211; This right means that, as far as it is technically possible, the Data Controller will transfer the User\u2019s Personal Data in a structured, commonly used machine-readable format for the User\u2019s own purposes;<\/li>\n\n\n\n<li>Right to object &#8211; The User may object to the processing of his\/her Personal Data where this is based on legitimate interests, in particular in the case of direct marketing;<\/li>\n\n\n\n<li>The right to lodge a complaint &#8211; the User has the right to lodge a complaint to the supervisory authority in charge of personal data protection (President of the Office for Personal Data Protection, ul. Stanis\u0142awa Moniuszki 1A, 00-014 Warsaw).<\/li>\n<\/ul>\n\n\n\n<p>To the extent that the User\u2019s data are processed on the basis of consent, such consent may be withdrawn at any time by contacting the Data Controller via e-mail &#8211; e-mail: <a href=\"mailto:sekretariat@tribag.pl\">sekretariat@tribag.pl<\/a> and in writing to the Data Controller\u2019s address. The withdrawal of consent does not affect the processing of personal data that took place prior to the User\u2019s declaration of withdrawal of consent.<\/p>\n\n\n\n<p>The User has the right to object to the processing of data for marketing purposes if the processing is carried out in connection with the legitimate interest of the Data Controller, as well as &#8211; for reasons related to the User\u2019s particular situation &#8211; in other cases where the legal basis for data processing is the Data Controller\u2019s legitimate interest (e.g. for analytical and statistical purposes).<\/p>\n\n\n\n<ol start=\"9\" class=\"wp-block-list\">\n<li><strong>DATA RECIPIENTS<\/strong><\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In connection with the provision of services, Personal Data will be disclosed to external entities, including in particular suppliers responsible for the operation of IT systems, social network operators, entities engaged in postal or courier services, and entities related to the Data Controller, including companies in its capital group.<\/li>\n\n\n\n<li>The Data Controller reserves the right to disclose selected information concerning the User to the competent authorities or to third parties who make a request for such information, based on the relevant legal basis and in accordance with the provisions of the applicable law.<\/li>\n<\/ul>\n\n\n\n<ol start=\"10\" class=\"wp-block-list\">\n<li><strong>TRANSFER OF DATA OUTSIDE THE EEA<\/strong><\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The level of protection of Personal Data outside the European Economic Area (EEA) differs from that provided by European law.
